The 2001 Tax Relief Act scheduled gradual reductions in the estate tax until 2010. The Act eliminates the estate tax in the year 2010. Be aware that the repeal is temporary. As of January 1, 2011, the estate tax reverts to previous levels, and federal estate tax will be assessed on estates exceeding $1 million. The maximum tax rate will again be 55%.
